In 1972 the foundation of Muslim Personal Law was laid down so that the protection of Muslims Personal Law in India can be safeguarded. Some people also say that Late Mrs. Indira Gandhi directed the formation of Muslim Personal Law Board to establish strong hold on Muslim Vote Bank.

The foundation of this Board was laid down by the hands of Maulana Asad Madani and Qari Tayyab Sb. deoband Chief Administrator therefore the impact of Wahabis was always there.

The representation of other sects of muslim community was always remain just for namesake. The post of Presidentship always remains always with the members of single sect with similar views. The Book of Islam Fiqa published by Personal Law Board contained only Fiq-e-hanafi the views of other sects was neglected.

Despite of the aforesaid circumstances if Muslim Personal Law Board has confined itself for the protection of personal law there would be no conflict, but slowly Board started to claim of Muslim leadership. Unfortunately nobody could make it.

From the demolition of Babri Masjid to the bloodshed of Muslims in Gujrat the Muslim Personal Law leadership fails to protect and safeguard Muslims due to which confidence of Muslims population on it almost ended. The second problem arose that Muslim Personal Law always prrojected one view of one sect as the view of whole Islam. This is one of the reason which leads Barelvi Muslims under the Presidentship of Tauqeer Raza Khan Sb. to form the All India Muslim Personal Board(Jadeed). on 4th November, 2004.And along with this they also announced that there is no space for Shia Muslims in their Board. After this verdict few responsible members of All India Muslim Personal Board gave irresponsible statements against Shia Muslims. This gave intensity to Shias need to have separate Board for themself. This issue got more strong and intensified because in 33 years of the All India Muslim Personal Board did not pay any atttention to any of the problem of Shia Muslims.

Therefore on 7th Jan., 2005. the members of Lucknow representatives organised a function at House of Aqil Nawab Sb. Dheori Rafeeq-ud-Daula, Kashmiri Mohalla under the leadership of Khateeb-e-Akbar Maulana Mirza Mohammad Athar Sahab. In which the Ulema and literate personalities participated in large numbers. All laid stress on the formation of separate Shia Personal Law Board. And at last Sadar-e-Jalsa Khateeb-e-Akbar Maulana Mirza Mohammad Athar Sahab addressed the meeting and asked for a month time to know the views of the whole spreaded Shia Muslim community across the country and so as to know what they wish?

As the news of the 'Jalsa'(meeting) spread the next day across the country through media. Ulema, Woqulas and Aamayedeen-e-Millat in large numbers started sending there opinion to Maulana Mirza Mohammad Athar Sahab and therefore for the job for which a month was asked got completed in only a week.

Therefore on 23rd Jan., 2005 from Majalis-e-Ulemay Hind one 'Jalsa' (meeting) was orgainsed at Imambara Husainabad in which prominent Ulema and Aamayedeen-e-Millat were invited. In this 'Jalsa' Maulana Mirza Mohammad Athar Sahab was nominated as President of Shia Personal Law Board. He was authorised to laid down the foundation of All India Shia Personal Board before the month of Moharram. Therefore on 29th Jan., 2005, 18 Zilhijja 1425 Hijri 11:00 a.m. at Saiyyaddul Millat Hall Shia PG College , Victoria Street, Lucknow 'Jalsa-e-Aam' was organised in which Ulema, Aamayedeen came in large numbers. In which the enthusiasm of people of shia Muslim community and Momineen was remarkable to be seen. Khateeb-e-Akbar Maulana Mirza Mohammad Athar Sahab announced the foundation of All India Shia Personal Law Baord with "NARAY-E-SALWAT" and "NARAY-E-HAIDERY".
